Terms of Use.

Tiffin University’s Student Accounts Office (the “Office,” “We,” “Us,” “Our”) uses SMS (Short Message Service) communications as an efficient way to contact current and former students about past due balances owed to Tiffin University (“TU”). The Office leverages this communication method to quickly and directly inform students about outstanding payments, to ensure that balances are addressed promptly, to provide a convenient way for students to take action, and to empower students to stay on top of financial responsibilities and avoid late fees or holds on their accounts. TU and the Office make these SMS communications in furtherance of its educational mission as a private, non-profit university.

The Office’s SMS messaging program (the “Program”) is subject to these SMS Terms and Conditions (the “Terms”). By participating in the Program, you are agreeing to be bound by the Terms, which are the equivalent of a signed, written legal contract between you, TU, and the Office.

TU and the Office reserve the right to modify, update, revise, or terminate the Terms, and the Office may make such modifications in its sole discretion as the offeror of the Program. In the event that the Office changes the Terms, the Office will notify you of the change within a reasonable amount of time, and the Office will determine the method by which you will receive the notification. Your continued participation in the Program following the Office’s notice of any change to the Terms will be considered your agreement to be bound by the Terms as modified. Any inconsistent terms between these Terms and any subsequent modifications to the Terms shall be controlled according to the latest version of the Terms.

Should you have any questions about the Terms or about the Program, you may contact TU and/or the Office using the contact information located in the last section of the Terms, entitled “Contact and Notification Information.”

User Opt-In and Opt-Out.

By providing your mobile telephone number to TU, you opted into the Program and agreed to receive recurring SMS communications from the Office. Message frequency may vary based on engagement and communication preferences. Regardless of the opt-in method you utilized to join the Program, you agree that these Terms apply to your participation in the Program.

Should you no longer wish to participate in the Program, you may opt out at any time by replying “STOP,” “QUIT,” “END,” “CANCEL,” “UNSUBSCRIBE,” or “STOP ALL,” to any TU’s SMS communication or by texting 419-405-3546. This is the easiest and preferred method to opt out of the Program, but you may also opt out by contacting TU at pctech@tiffin.edu. Upon receiving your opt-out notice, the Office will promptly remove you from the Program, but you may receive an additional mobile message confirming your decision to opt out.

Please note that opting out will remove you from all future SMS communications with the Office. You may re-subscribe to the Program at any time.

Cost and Frequency.

Message frequency varies and standard message and data rates may apply. When you opt-into the Program, you are responsible for any carrier fees such as data plan charges, text message charges, tolls, out-of-area roaming and other charges. Contact your mobile carrier for details on text messaging fees.

Carriers.

Note that SMS communications from the Office may not be available through all mobile carriers. Should you have any questions about your ability to receive SMS communications from the Office, you should contact your mobile carrier.

SMS Communications by TU.

In operating the Program, the Office reserves the right to determine the method by which the Office transmits SMS communications to you, and the Office may use a third-party vendor to transmit SMS communications to you. In the event that the Office uses a third-party vendor in connection with the Program, the third-party vendor is responsible for all aspects of transmitting SMS communications to you, and the Office disclaims any and all responsibility for the third-party vendor’s actions or omissions.

By opting into and/or continuing to participate in the Program, you expressly consent to receive SMS communications from the Office, regardless of whether such SMS communications are transmitted directly by the Office or are transmitted by a third-party vendor, and you agree to receive SMS communications at any time of day, including but not limited to after 9:00 p.m. your local time and before 8:00 a.m., and/or at times that may

presumptively be considered unusual or inconvenient times and at any place (including any unusual place that may be considered inconvenient to you) including, without limitation, for the purposes of collecting monies owed by you to TU. You acknowledge and understand that the Office has no responsibility for a third-party vendor’s actions or omissions.

Representations, Warranties, and Limitations of Liability.

The Program is provided to you as a convenience, and the Office’s goal is to provide accurate and timely information. However, there may be inadvertent, technical or factual inaccuracies, and/or typographical errors in the SMS communications. Furthermore, there are certain aspects of SMS communications that the Office cannot control, and delivery of mobile messages is subject to effective transmission from your wireless service provider/network operator. Neither TU nor the Office, therefore, make any representation that the Program will be uninterrupted or error free, and the Office does not warrant the accuracy, completeness or timeliness of the information, text, graphics, links or other items in SMS communications, the time at which you may receive SMS communications, or the privacy of responses to SMS communications.

TU and the Office further represent and warrant that TU is a non-profit, tax-exempt institution, as defined by 26 U.S.C. § 501(c)(3), and the Office uses the Program to communicate information related to TU’s educational mission and operations. In operating the Program, TU and the Office assert and rely on any and all exemptions for non-profit and/or charitable institutions in any law that regulates or purports to regulate the transmission of SMS communications. By participating in the Program and receiving SMS communications from the Office, you acknowledge and understand that TU is a non-profit, tax-exempt institution and that TU may be exempt from certain laws regulating or purporting to regulate the transmission of SMS communications.

By participating in the Program, you agree that TU will not be liable for the consequences of any interruptions to or errors in the Program, and/or any delays or failures to your receipt of SMS communications. UNDER NO CIRCUMSTANCES WILL TU BE LIABLE FOR ANY DIRECT OR INDIRECT, SPECIAL, STATUTORY, INCIDENTAL OR CONSEQUENTIAL DAMAGES THAT MAY ARISE IN CONNECTION WITH YOUR PARTICIPATION IN THE PROGRAM AND/OR SMS COMMUNICATIONS FROM OR TO THE OFFICE. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. In such jurisdiction, our TU’s is limited to the greatest extent permitted by law.

Governing Law.

The Terms are governed by Ohio law without regard to any conflict of law.

Privacy Policy

Your participation in the Program is governed by the TU’s Privacy Policy to the extent applicable. Neither TU nor the Office will ask you for, nor should you provide, personally identifiable information, passwords, or any other confidential or sensitive information in SMS communications. Except as permitted by TU’s Privacy Policy and these Terms, TU does not share your information with third parties.

TU and the Office will take all reasonable measures to keep your mobile telephone information remain confidential, and such information will be used only by university representatives or third-party vendors to assist you in a more efficient way. Offices, departments or organizations at the university may collect and use information in forms different than described herein, and as such, you should review TU’s Privacy Policy, and the policies of any other electronic services or website that you may use.

Although TU and the Office will try to protect information you send Us via SMS communication, neither TU nor the Office can guarantee that information sent over a mobile service network or the internet is completely confidential. There are certain aspects of mobile service networks, internet usage, and your mobile device that neither TU nor the Office can control. Therefore, transmission of information to and from TU or the Office via SMS communication must be undertaken at your own risk.

Mobile information will not be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
