SMS Terms and Conditions — Office of University Advancement

Terms of Use

Tiffin University’s Office of University Advancement (the “Office,” “We,” “Us,” “Our”) uses SMS (Short Message Service) communications to connect with donors, alumni and advancement constituents on behalf of Tiffin University (“TU”). The Office uses this communication method to share information about:

  • Fundraising appeals and solicitations
  • Alumni engagement opportunities
  • Campaign updates and giving reminders
  • Event invitations and announcements
  • Other advancement-related news and updates

Through these SMS communications, the Office aims to keep you informed, provide convenient ways to stay involved, and strengthen your connection to the TU community. TU and the Office send these SMS communications in furtherance of its educational mission as a private, non-profit university.

The Office’s SMS messaging program (the “Program”) is subject to these SMS Terms and Conditions (the “Terms”). By participating in the Program, you are agreeing to be bound by the Terms, which are the equivalent of a signed, written legal contract between you, TU, and the Office.

TU and the Office reserve the right to modify, update, revise, or terminate the Terms at any time, and the Office may make such modifications in its sole discretion. In the event that the Office changes the Terms, the Office will notify you of the change within a reasonable amount of time. Your continued participation in the Program following notice of any change will be considered your agreement to be bound by the updated Terms. Any inconsistency between these Terms and any subsequent modifications shall be controlled by the latest version of the Terms.

Should you have any questions about the Terms or the Program, you may contact TU and/or the Office using the contact information in the last section of these Terms, entitled “Contact Information.”

User Opt-In and Opt-Out

Opt-In: By providing your mobile telephone number to TU, you opted into the Program and agreed to receive recurring SMS communications from the Office of University Advancement at Tiffin University. To re-subscribe at any time, reply START to any TU SMS message or text START to 419-405-3546. Regardless of the opt-in method you used to join the Program, you agree that these Terms apply to your participation.

Opt-Out: Should you no longer wish to participate in the Program, you may opt out at any time by replying STOPQUITENDCANCELUNSUBSCRIBE, or STOP ALL to any TU SMS communication, or by texting STOP to 419-405-3546. You may also opt out by contacting TU at pctech@tiffin.edu. Upon receiving your opt-out request, the Office will promptly remove you from the Program. You may receive one final confirmation message acknowledging your opt-out.

Please note that opting out will remove you from all future SMS communications with the Office. You may re-subscribe to the Program at any time by replying START.

Message Frequency and Cost

Message frequency varies and is based on your engagement and communication preferences. You may receive up to several messages per month depending on active campaigns, events, and fundraising activity. Message and data rates may apply. When you opt into the Program, you are responsible for any carrier fees, including data plan charges, text message charges, roaming charges, and other applicable fees. Carriers

SMS communications from the Office may not be available through all mobile carriers. If you have questions about your ability to receive SMS communications from the Office, please contact your mobile carrier.

SMS Communications by TU

In operating the Program, the Office reserves the right to determine the method by which it transmits SMS communications to you, and the Office may use a third-party vendor to facilitate SMS delivery. Any third-party vendor used in connection with the Program is responsible for all aspects of transmitting SMS communications to you. The Office disclaims responsibility for a third-party vendor’s actions or omissions.

By opting into and/or continuing to participate in the Program, you expressly consent to receive SMS communications from the Office of University Advancement at Tiffin University, whether transmitted directly by the Office or by a third-party vendor. You agree to receive SMS communications at any time of day, including after 9:00 p.m. or before 8:00 a.m. your local time, for the purposes of advancement, fundraising, and alumni engagement communications on behalf of TU. You acknowledge that the Office has no responsibility for a third-party vendor’s actions or omissions.

Representations, Warranties, and Limitations of Liability

The Program is provided as a convenience, and the Office’s goal is to provide accurate and timely information. However, there may be inadvertent technical or factual inaccuracies and/or typographical errors in SMS communications. Delivery of mobile messages is also subject to effective transmission from your wireless service provider or network operator. Neither TU nor the Office makes any representation that the Program will be uninterrupted or error-free, and neither warrants the accuracy, completeness, or timeliness of any information contained in SMS communications.

TU and the Office further represent and warrant that TU is a non-profit, tax-exempt institution as defined by 26 U.S.C. § 501(c)(3), and that the Office uses the Program to communicate information related to TU’s educational mission and operations. In operating the Program, TU and the Office assert and rely on any and all exemptions for non-profit and/or charitable institutions under any law that regulates the transmission of SMS communications. By participating in the Program, you acknowledge and understand that TU is a non-profit, tax-exempt institution and may be exempt from certain laws regulating SMS communications.

By participating in the Program, you agree that TU will not be liable for any interruptions to or errors in the Program, or any delays or failures in your receipt of SMS communications. UNDER NO CIRCUMSTANCES WILL TU BE LIABLE FOR ANY DIRECT OR INDIRECT, SPECIAL, STATUTORY, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR PARTICIPATION IN THE PROGRAM AND/OR SMS COMMUNICATIONS FROM OR TO THE OFFICE. In jurisdictions that do not allow such exclusions or limitations, TU’s liability is limited to the greatest extent permitted by law.

Governing Law

These Terms are governed by the laws of the State of Ohio without regard to any conflict of law principles.

Privacy Policy

Your participation in the Program is governed by TU’s Privacy Policy to the extent applicable. Neither TU nor the Office will ask you for, nor should you provide, personally identifiable information, passwords, or any other confidential or sensitive information via SMS communications.

We do not share SMS opt-in information with third parties for marketing or promotional purposes. We may share your information with service providers who assist in the delivery and operation of the SMS Program; such providers are permitted to use your information only as necessary to deliver SMS communications on our behalf. All categories of data sharing described elsewhere in TU’s Privacy Policy exclude text messaging originator opt-in data and consent — this information will not be shared with any third parties for marketing purposes.

TU and the Office will take all reasonable measures to keep your mobile telephone information confidential. Such information will be used only by university representatives or authorized third-party vendors to support Program communications. You should also review TU’s Privacy Policy and the policies of any other electronic services or websites you use, as other university offices or departments may collect and use information differently.

Although TU and the Office will make reasonable efforts to protect information you send via SMS, neither TU nor the Office can guarantee that information transmitted over a mobile service network or the internet is completely confidential. Transmission of information to and from TU or the Office via SMS must be undertaken at your own risk.
